aboriginal people of Australia are treated FAR worse than anyone in Ireland, north or south, so I can understand frustration and a need take claim territory and it’s associated benefits.

However, the courts were US courts too, so the legitimacy of the court was used to question the legality of a US land claim. This is "not meat nor fish", but it works. So, people pick and chose whatever helps them.
