- People keep asking for the 25th amendment to be invoked. Here are the details on that and why it’s not gonna happen. 1. The Vice President plus a majority of the cabinet must formally declare the President is “unable to discharge the powers and duties of the office”
- 2. That declaration must be written and sent to the Speaker of the House and the President pro tempore of the Senate. If the President fights it (he certainly will) then: 1. The President can send a letter saying “Actually, I’m fine” 2. Then the VP + Cabinet have 4 days to reassert their claim.
- 3. If they do, Congress must vote: • 2/3 of the House • 2/3 of the Senate 4. If both chambers hit 2/3, the VP stays Acting President. If not, the President gets power back.
