- Terminally Ill Adults (End of Life) Bill clause 3 states: In this Act, references to a person having capacity are to be read in accordance with the Mental Capacity Act 2005. This is a bit odd as the 2005 Act describes those who lack capacity. There is no explicit definition of who has capcacity
