Someone explain why some want to eliminate birthright citizenship, when a clear reading of the 14th Amendment to the U.S. Constitution states the following: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States[.]”
IANAL, but it seems the only appropriate remedy, for those that seek to eliminate birthright citizenship, would be a constitutional amendment removing the 14th Amendment, Section 1.
There is something inherently wrong—and hypocritical—in having SCOTUS’ conservative justices “legislate from the bench,” something right-wingers complain of, in crafting caselaw to somehow circumvent a clear reading of the U.S. Constitution—which is literally the “supreme Law of the Land.”
