I think it's pretty clear from the transcript of the Julie Le hearing that ICE/DHS is intentionally setting up a defective system of detention so that it can use the purported failures of the "system" as an excuse to ignore or delay complying with court orders

At one point the judge is like, Who is responsible for releasing these people? AUSA Voss is like, I don't know, AG Bondi, Kristi Noem?
The judge is like, Surely the orders don't go to the AG. So she says it goes to agency counsel and then to someone else in operations.
