- 1/On July 15, the EU Foreign Affairs Council (FAC) once again failed to act in line with both its own legal obligations & international law. Instead of taking concrete measures in response to Israel’s human rights violations, it opted for a “humanitarian deal” & vague monitoring.
- 2/ The EU has concluded that Israel is in breach of Article 2 of the EU-Israel Association Agreement (AA), which conditions relations on respect for human rights & democratic principles. It is a legal red line that ought to trigger consequences, including suspension of the AA.
- 3/ Instead, the EU settled for a so-called humanitarian deal and committed to “monitoring” how Israel- a state credibly accused of genocide by the ICJ- would implement it. States should not “monitor” genocide, but act to stop it.
